Café operator faces Court over serious record-keeping failures

Café operator faces Court over serious record-keeping failures

May 4, 2017 By James L Leave a Comment

The operators of Canberra cafe Cafe Garema are facing legal charges for failing to keep accurate payslips and records as according to Australia’s workplace laws. Failure to keep accurate records is a serious issue for the Labor agency because it prevents the agency from knowing whether workers were adequately paid and if they were underpaid, how much they were underpaid by. Based on the minimal records the Cafe kept, officials were able to determine the cafe underpaid workers $1353 over a period of two weeks.

Key Takeaways:

  • The administrator of a Canberra bistro and its chiefs are confronting court for claimed genuine negations of record-keeping and payslip laws.
  • In spite of the poor record keeping hones, the Fair Work Ombudsman likewise charges that YBI came up short on 12 representatives their base privileges under the applicable Award.
  • James says, in light of records kept by YBI covering a two week time frame, reviewers could distinguish that the bistro’s representatives gotten level rates of amongst $14 and $20 every hour.

“The Fair Work Ombudsman alleges that YBI failed to make or keep appropriate records as required under Australia’s workplace laws by failing to record employees’ names, commencement dates, hours worked, rates of pay, payments made, leave accrued or taken, superannuation payments, or issue payslips.”
